‘How to Market your Holiday Accommodation Online’

The Purchaser is granted the right to access and download the eBook on the Terms and Conditions outlined herein. The Purchaser has the right to install the eBook on one computer and print copies for non-commercial use only. The Purchaser is solely responsible for ensuring Adobe PDF files will work on their computers. The Purchaser must not use the eBook or any part thereof for any purpose which is in contravention of the Terms and Conditions or in a manner which will infringe the copyright, trademarks, service marks or other intellectual property rights of the Author or other third parties or violate the privacy, publicity or other personal rights of others or in any defamatory, obscene, threatening, abusive or hateful manner.

All content contained in the eBook belongs to and is the sole property of the Author. The entire contents of the eBook are protected by copyright, unless otherwise indicated. Full-scale copying of the eBook contents is expressly prohibited. The Purchaser may not remove, delete, transmit or create derivative works from any of the eBook content. No part of any chapter of the eBook may be transmitted in any form by any means or reproduced for any other purpose, without the prior written permission of the Author.

purchaser breach

The unauthorized use or distribution of the eBook is illegal and could subject the Purchaser to substantial monetary damages. The Purchaser will be liable for any damage resulting from any violation of the Terms and Conditions, including any infringement of copyrights or proprietary rights.

Any breach by the Purchaser of the Terms and Conditions may result in the Purchaser no longer having access to the Website. If the Purchaser’s permission to use the Website has been terminated for any reason, the Terms and Conditions will nevertheless continue to apply and be binding upon the Purchaser in respect of their prior use of the eBook and the Website.

no warranties

The information in the eBook is distributed on an "As Is" basis, without warranty of any kind, either express or implied or statutory, including, without limitation, implied warranties of merchantability and fitness for a particular purpose. The information in the eBook is not business advice. While every precaution has been taken in the preparation of the eBook, the Author shall not have any liability to any person or identity with respect to any loss or damage caused or alleged to be caused directly or indirectly by the use of information contained in the eBook.

No guarantee of success is ever given now or at any other time to any Purchaser of this eBook and the Author assumes no legal responsibility or liability for the application of the instructions contained therein. Furthermore, the Purchasers’ success or failure may be due to factors beyond the control of the Author, either directly or indirectly.

release

The Author will not, under any circumstances, be liable to the Purchaser or any other person for any loss of use, loss of production, loss of income or profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the use of the eBook by the Purchaser or any other person and notwithstanding that the Author may have been advised of the possibility of such loss or damages being incurred by the Purchaser or any other person.

In no event will the Author’s total liability to the Purchaser or any other person for any claims, proceedings, liabilities, obligations, damages, losses, and costs, whether in contract, tort or under any other theory of law or equity exceed $59.95 (AUD) or the amount the Purchaser paid for the use of the eBook, whichever is less.

Whilst all reasonable attempts to exclude viruses from the eBook, exclusion of viruses cannot be ensured and no liability is accepted for damage caused through the downloading of viruses. The Purchaser is recommended to take all appropriate safeguards before downloading the eBook.

indemnity

The Purchaser agrees to indemnify, defend and hold harmless the Author and all his respective agents, officers, employees, information providers, service providers, suppliers, licensors and licensees, and all other related, associated, or connected persons (collectively, the "indemnified parties") from and against any and all liabilities, expenses and costs, including without limitation reasonable legal fees and expenses, incurred by the indemnified parties in connection with any claim or demand arising out of, related to, or connected with the Purchaser’s use of the eBook. The Purchaser will assist and co-operate as fully as reasonably required by the indemnified parties in the defense of any such claim or demand.

no representations

Any advice and information provided by the Author or his representatives, whether oral or written, will not create any representation, warranty or condition or vary or amend the Terms and Conditions and the Purchaser may not rely upon any such advice or information.

no waiver

Any failure by the Author to exercise or enforce any of his rights under the Terms and Conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent reinforcement of any such rights.

format

The eBook is in .pdf format. The Purchaser will require Adobe Acrobat Reader software installed on their computer to read the eBook. The Purchaser can download Acrobat Reader for Free from Adobe.com.

payment and delivery

Secure credit card payments to the Website are processed through PayPal. Neither the Website or the Author see the Purchaser’s credit card details.

All Purchasers who purchase the eBook will receive an immediate link to the eBook upon payment to PayPal. No confirmation email will be sent. If the Purchaser fails to receive their download link, or close the window before they are able to follow the link, they should contact who will gladly assist the Purchaser with their transaction. The Purchaser will be required to provide the confirmation number of their payment which should come via email from PayPal.

governing law

If there is any dispute involving any item or service, the Purchaser agrees that the dispute will be governed by and construed in accordance with the laws of the State of New South Wales.

severance of provisions

If any provision of the Terms and Conditions are found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of the Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

passwords

Reader only resources contained on the Website may be accessed only by use of the Purchaser’s email address and a password. The use of a password does not restrict access by the Author to the password-protected information. Passwords may not be shared. For security reasons, the Purchaser must keep the password confidential and not disclose it to any person or permit any other person to use them.

The Purchaser must immediately notify of any unauthorized use of the password, or if the Purchaser knows or suspects that the password has been stolen, has become known to any other person, or has been otherwise compromised.

third party websites

The eBook and the Website contain links to websites operated by parties other than the Author. Such links are provided for the Purchaser's convenience only. The Author does not control such websites, and is not responsible for their content. The Purchaser is solely responsible for evaluating the accuracy and completeness of any information contained on the third party website and also the value and integrity of any goods and services offered by such website.

changes to the terms and conditions

The Purchaser must not change, supplement, or amend the Terms and Agreements in any manner. The Author may, in his sole discretion, change, supplement or amend the Terms and Conditions as it relates to the future use of the eBook and the Website from time to time, for any reason, and without any notice or liability to the Purchaser or any other person, by posting revised Terms and Conditions on the Website.

refund policy

The Purchaser may at any time within 365 days of purchasing the eBook request a full refund from the Author.

notices

All correspondence and notices shall be via email to and shall be deemed received within five (5) business days after being sent. Either party may from time to time change its notice address by written notice to the other party.

entire agreement

Your use of the eBook constitutes your agreement to the Terms and Conditions. The Terms and Conditions are subject to change without notice.
